These Terms of Service ("Terms") govern your use of the LearnPass mobile application and the learnpass.ai website (collectively, the "Service"), operated by District 22 Agency Inc. ("we," "us," "our").
By downloading, installing, or using LearnPass, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
LearnPass is a vocabulary learning application that uses app blocking as a learning incentive. Users answer flashcard questions to earn banked minutes of screen time for selected apps. The Service includes AI-powered vocabulary generation, spaced repetition learning, app blocking via native platform APIs, subscription-based access to all features, and learning statistics and progress tracking.
2. Eligibility
You must be at least 13 years old to use LearnPass. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.
3. Account Registration
You may create an account using Google Sign-In. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
4. Subscription and Payment
LearnPass requires a paid subscription to access the Service. Current pricing is available within the app and may change with notice. Subscriptions are billed through the Apple App Store or Google Play Store. A 3-day free trial is available for new subscribers. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the selected plan rate. Subscriptions renew automatically at the end of each billing period (monthly or annually) unless cancelled. To cancel, manage your subscription through your App Store or Google Play account settings. Refunds are handled according to Apple's or Google's refund policies. We do not process refunds directly.
5. App Blocking and Screen Time Permissions
LearnPass uses Apple's Screen Time API (FamilyControls) on iOS and Android's UsageStats and Accessibility Service to block selected apps. By enabling app blocking, you grant LearnPass permission to manage access to apps you select. You can modify your blocked apps list or disable blocking at any time through the LearnPass Settings tab. LearnPass is not responsible for any missed notifications, calls, or messages from blocked apps while blocking is active. App blocking functionality depends on operating system permissions and may be affected by OS updates or changes to platform APIs. We cannot guarantee uninterrupted blocking functionality.
6. Banked Minutes
Correctly answering flashcard questions earns banked minutes (1 correct answer = 1 minute). A configurable cap (default 30 minutes, adjustable to 15 or 60) limits the maximum banked minutes. Minutes carry over across days and do not reset daily. Wrong answers carry no penalty. LearnPass reserves the right to adjust the banked minutes mechanic in future updates.
7. AI Generated Content
LearnPass uses OpenAI's GPT-4o-mini to generate vocabulary definitions, example sentences, and translations. AI-generated content is provided for educational purposes and may occasionally contain inaccuracies. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. AI-generated images and audio are provided as learning aids and are not warranted to be error-free.
8. User Content
When you add custom words or interact with the Service, you retain ownership of any content you create. By using the Service, you grant us a limited license to process your inputs (custom words, topic selections) through our AI providers solely to generate learning content for you.
9. Acceptable Use
You agree not to use the Service to violate any applicable law or regulation, attempt to circumvent or tamper with the app blocking functionality through unauthorized means, reverse engineer, decompile, or disassemble any part of the Service, use the Service in any way that could harm, disable, or impair its operation, create accounts through automated means or under false pretenses, or redistribute, resell, or sublicense any part of the Service.
10. Intellectual Property
The LearnPass name, logo, design, and all original content within the Service are the property of District 22 Agency Inc. The bundled word database and AI-generated content within the app are provided for your personal, non-commercial learning use only. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
APP BLOCKING RELIES ON PLATFORM APIs CONTROLLED BY APPLE AND GOOGLE. WE DO NOT GUARANTEE THAT BLOCKING WILL FUNCTION PERFECTLY IN ALL CIRCUMSTANCES, INCLUDING AFTER OPERATING SYSTEM UPDATES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISTRICT 22 AGENCY INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO MISSED COMMUNICATIONS DUE TO APP BLOCKING, LOSS OF DATA, OR INACCURACIES IN AI-GENERATED CONTENT.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless District 22 Agency Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
14. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 11, 12, 13, and 15 survive termination.
15. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of British Columbia.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on learnpass.ai and updating the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and District 22 Agency Inc. regarding the Service.
